Three Tiers of Drunk Driving Penalties
In Pennsylvania, DUI arrests usually result in misdemeanor charges. However, if a DUI offense involves serious injury or death, the case will most likely lead to felony charges. Both types of charges carry harsh consequences.
When charged as a misdemeanor, penalties are divided into three tiers, based upon a driver’s blood alcohol content (BAC).
The three tiers include:
- First tier—general impairment. For those who have a BAC of 0.08 percent to 0.099 percent, they face a mandatory minimum sentence of 6 months’ probation, a $300 fine, and DUI classes.
- Second tier—high rate. For those who have a BAC of 0.10 percent to 0.159 percent, they face a mandatory minimum sentence of 48 hours in jail followed by 6 months’ probation, a $500 fine, a 1-year license suspension, and DUI classes.
- Third tier—highest rate. For those who have a BAC of 0.16 percent or higher, they face a mandatory minimum sentence of 72 hours in jail followed by 6 months’ probation, a $1,000 fine, 1-year license suspension, and DUI school.
Each tier’s mandatory minimum penalties increase based on the number of previous offenses. For example, an individual who is charged according to the first-tier but has two past offenses will have their mandatory minimum penalty increased to 10 days in prison, a $500 fine, and 1 year of an ignition interlock device on their vehicle.
